Legal or not ?

Hello people ,.. i was initialy tempted to send a mail to the staff that makes this usefull tool about what i`m about to say here to include some kind of warning in the license agreement but not many ppl actually read that when they click next+next+finish to install the software and well this might concern more ppl. then just the creators of the software ...

I live in Romania (unfortunately) and 1 hour ago i just got home from police hq. having been called there to give some statements for using a illegal filesharing software meaning this one ofc ... apparently a recent modification to the 8/1996 law ART. 139^9 that states :

"Constituie infractiune si se pedepseste cu inchisoare de la 1 la 4 ani sau cu amenda de la 100.000.000 lei la 400.000.000 lei reproducerea neautorizata pe sisteme de calcul a programelor de calculator in oricare dintre urmatoarele modalitati: instalare, stocare, rulare sau executare, afisare ori transmitere in retea."

meaning:

It is considered a felony and is punishable with prison from 1 to 4 years or fine 1.000 RON - 4.000 RON (250 euro - 1000 euro) the unatorized reproduction of any type of data that someone anywhere has author rights to, on any type of storage device (including one`s own personal PC.) trough any of the following methods: installation / storage / execution / listing or transmitting in any type of network.

As such any form of filesharing software is considered ilegal ... a campaign against any filesharing software users is goying on around here and hundreds of law suites are happening. This might interest the firms that makes those kind of software as well as the users depending on where they live (what laws are in they`re country in regards to this matter) ... should any wanna sue somebody to get it off the blacklist the world will be a safer place ... to use this software :)

I`m saying this because this law interpreted by choice of the reader clearly breaks some of the U.E. constitution rights i think every states constitution mentioned rights of the individual person from witch the right to privacy and one of the adons to it saying the sharing of data between 2 individual party`s. That should apply since this is not a software that anyone can sell data with and so gaining any economic benefits from the data they share.

Hey Laurentiu83. Sorry to hear about that, did you pay a fine?

The software is legal in the developers' country. We warn anybody that openly admits to using it for infringing copyright and we do not provide support for those people. It is your responsibility to abide by the laws in your country. My suggestions for increased privacy are to always use the built in encryption and connect to a adcs:// hub. This will stop ISP or anybody snooping on your connection identifying the files you are downloading and keep your privacy. Try and stick to trusted private hubs.

i`m in little if any trouble from this ... i can say how they did it ... they went to provider and logged in on the hubs accesing each local user and matched ip to the ip from provider login server and traced name & address on the contracts ,... they made printscreens of the shared folders and stuff ,.. not accusing of me of transfering any files to anybody but for simply listing/storing and making them availabile

Probably why you paid no fine. :)

Stick to private hubs for your own privacy.

and about that ... why does the software nead to display the user IP`s adress actualy ... as a user why would i care what the other user IP adress is ...

There are ways to manipulate your IP address, look at programs like TOR.

I do believe one question ,... or rather the answer to it would help me out... that u guys can give me

the individual file list of each user of Apex DC is stored on the server(hub) or the computer of that individual user ?

i do remember that clicking the user from the hub list comes with the option get file list ... is that stored on that user`s computer ?

Yes, stored on the computer that initiated the Get filelist command.

i meant ... for example,.. my file list is stored on my personal computer or the server/ hub to witch i am connected to ?
